1 John Dale Enoch was charged, tried, and convicted in the Municipal Criminal Court of the City of Oklahoma City,
for the crime of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor, and his punishment fixed at thirty
(30) days in the city jail. From that judgment and sentence he has appealed to this Court. 2 This cause was lodged in this Court on November 14, 1967. Brief was due to be filed by December 4, 1967; however,
no brief was filed, nor an extension of time in which to file a brief requested. Therefore, on December 28, 1967, by order
of this Court, the cause was summarily submitted for opinion in accordance with Rules Six and Nine of this Court.
